Broderick's Music operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Broderick's Music is powered by Shopify, which enables us to provide the Services to you.

All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products we offer to any person or region.

Section 3 - Orders

When you place an order, you are making an offer to purchase. Broderick's Music reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order has been accepted. If we do not accept, need to change, or cancel an order, we will attempt to notify you using the email, billing address, or phone number provided at the time the order was made.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Your right to cancel. If you are a consumer purchasing from within the European Union, you have the right to cancel your order and receive a refund within 14 calendar days of receiving your goods, without giving a reason, under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013. To exercise this right, please contact us at info@brodericksmusic.com before the 14-day period expires. Goods must be returned in their original condition and packaging, and you are responsible for the cost of return postage unless the goods are faulty. This right to cancel does not apply to goods made or personalised to your specification, special orders, or goods that have been used or installed beyond opening and inspecting them.

Your purchases are also subject to return or exchange in accordance with our Refund Policy.

Section 4 - Prices and Billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed, and will be set out in your order confirmation email. All prices are shown in Euro and include VAT at the applicable rate, unless stated otherwise. Delivery, handling, customs or import charges are additional unless expressly stated.

If a product is listed at an incorrect price due to a typographical error or other mistake, we will inform you as soon as possible and you will have the option to proceed with the order at the correct price or cancel it.

Prices in our online store may differ from prices in our physical store. We may run promotions from time to time that are governed by separate terms; where those terms conflict with these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information, and to promptly update it, including your email address and payment details, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are duly authorised to use the payment method for the purchase, and (iii) you will pay all charges incurred at the posted prices, including delivery charges and applicable taxes.

Section 5 - Shipping and Delivery

We aim to despatch and deliver orders promptly, but all delivery times are estimates only and are not guaranteed. We are not liable for delays caused by couriers, customs processing, or events outside our reasonable control. Once we transfer products to the carrier, risk of loss passes to you, though your statutory rights as a consumer are not affected.

Section 6 - Repairs, Servicing and Hire

Where we provide instrument or equipment repairs, servicing, or hire, the following applies in addition to the rest of these Terms:

We will provide you with an estimate or quotation where practical before carrying out chargeable repair work. We will contact you if additional work is needed beyond what was originally agreed.

Items left with us for repair or servicing should be collected within a reasonable time of being notified that the work is complete. We are not responsible for items left uncollected for an extended period, though we will make reasonable efforts to contact you beforehand.

Hired equipment remains our property at all times. You are responsible for the equipment for the duration of the hire period and agree to return it in the condition it was supplied, fair wear and tear excepted. You will be liable for the cost of repair or replacement of any hired equipment that is lost, damaged, or not returned.

Faults arising from misuse, accidental damage, or normal wear and tear are not covered by warranty and may be chargeable to repair.

Section 7 - Intellectual Property

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement of them, are owned by Broderick's Music, its affiliates or licensors, and are protected by Irish, EU, and other applicable intellectual property laws.
